Thing is, he will eventually remember. By then, he'll disappear and commit even more murders. Say what you will, bring up any tv show bullcrap or movie bullcrap. He will eventually remember and go on continuing what he did. But as long as he doesn't remember, they should let him free, but keep a close eye on him.

Permanent brain damage. As in, never remembering any single thought of his pass.

It's a hypothetical situation regarding a random person, not the case mentioned in the OP. That was merely background information.

Why not a drug that wipes memory. How do any of you feel about the government clearing your memory and "re-educating" you (because of criminal behavior)?

If I understand this right the question is "Do you charge him?". Yes. It's up to the court to weigh the evidence and decide should he be punished or given a second chance. If the evidence supports the charge he should be found guilty.

What you do with him then is a different question all together imho.

The question in its entirety is "Do you charge someone whom has no capability of remembering their actions?"

 

Why not a drug that wipes memory. How do any of you feel about the government clearing your memory and "re-educating" you (because of criminal behavior)?

That could work, but it would probably do more harm than good if it wipes your ENTIRE memory.

 

If you meant only wiping the part about the crime, then that would be very hard if not impossible to do with out current technology.
